At Flipcash Inc., (“Flipcash”, “us”, “we”, “our”), we value and respect your privacy. We have prepared this privacy policy to explain the manner in which we collect, use, disclose and otherwise process personal information when you download and use the Flipcash mobile application (the “Flipcash App”) or use the Flipcash website located at www.flipcash.com, including all associated subdomains (the “Flipcash Website”) and in our other interactions with you.
The Flipcash App is a non-custodial wallet that allows users to access certain Digital Assets that we support, send and receive Digital Assets, and buy and sell Digital Assets (including through Coinbase Guest Checkout, which supports payment via Apple Pay or Google Pay Guest Checkout). The Flipcash App also includes a Currency Creator feature that enables users to create new digital currencies on the blockchain ("User-Created Currencies"), and facilitates interactions with on-chain smart contracts that govern the liquidity and pricing of User-Created Currencies ("Reserve Contracts"). Reserve Contracts utilize USDF, a custom stablecoin issued by Coinbase, Inc. ("Coinbase"), as the primary reserve asset.
COLLECTION AND USE OF PERSONAL INFORMATION
Means of Collection: Flipcash does not collect any personal information from users at the time of account creation. Access to the Flipcash App is provided via download through third-party platforms such as the Apple App Store and Google Play Store. Any information collected by these platforms is governed by their respective privacy policies. For the avoidance of doubt, while no personal information is collected at the time of account creation, certain information — including device information, usage data, and other categories described in this Privacy Policy — may be collected automatically during your subsequent use of the Flipcash App.
We collect personal information that you provide directly to us (through the Flipcash App, the Flipcash Website or through other communication channels) as well as information your devices provide to us automatically.
We may collect personal information through the Flipcash App, the Flipcash Website, and our other interactions with you, including when you:
Create an account and user profile
Use the Flipcash App
Participate in our surveys
Sign up for marketing emails
Contact us with a comment, question or complaint
Creating an Account and User Profile: The Flipcash App is available to download through the Apple App Store and Google Play Store. Flipcash does not collect, access, or store any personal information from users at the time of account creation. All authentication, billing, and account management is handled through your App Store or Google Play account in accordance with their respective terms and privacy policies.
Flipcash does not require users to register separately or create a profile within the App. No personal identifiers (such as phone numbers, names, or contact lists) are collected or stored by Flipcash at this stage.
Once your account is activated, we may collect certain limited information to create your user profile, and information about your device’s registered locale and language preferences. We use information regarding your location to provide an up-to-date value of your Digital Assets in relation to your local currency.
Using the Flipcash App: We collect and use certain information when you use the Flipcash App, such as information about your Digital Assets transactions (e.g., deposits and withdrawals, and records of Digital Assets sent to or received from other Flipcash users). We use this information to keep records of your transactions, and to update your Flipcash App. For users located in the United States, use of Coinbase’s Onramp product via Apple Pay or Google Pay Guest Checkout through the Flipcash App will collect your phone number, email address, and verification codes. This information is transmitted directly to Coinbase and processed under their Privacy Policy (located at: https://www.coinbase.com/legal/privacy). Flipcash does not receive, access, retain, or store any of the foregoing information (including your phone number, email address, or verification codes) at any time, whether transiently or otherwise; such data is collected and processed exclusively by Coinbase. Please refer to the “Coinbase Guest Checkout” section below for more information.
Currency Creator and Reserve Contract Activity: If you use the Currency Creator feature to create a User-Created Currency or interact with Reserve Contracts (including buying or selling User-Created Currencies), we may collect and use information about such activity, including transaction metadata, wallet addresses involved in the transaction, the identity and parameters of any User-Created Currency you create, and records of your interactions with Reserve Contracts (such as buy/sell amounts and pricing data). We use this information to facilitate the functionality of the Flipcash App, maintain transaction records, and improve the Flipcash Solution. We may also collect information related to your acquisition, transfer, or redemption of USDF in connection with Reserve Contract interactions or other supported functionality within the Flipcash App. To the extent that any personal information is transmitted to or processed by Coinbase in connection with USDF-related transactions, such processing is governed by Coinbase's Privacy Policy; Flipcash does not receive, access, or store any personal information collected directly by Coinbase in its capacity as issuer of USDF.
User-Created Currency Content: In addition, when you create a User-Created Currency, you may choose to assign it a name, description, and upload an image or logo. To the extent that any such information constitutes or contains personal information (for example, if you incorporate your name, likeness, or other identifying information into a currency name or logo), you acknowledge that this information may be recorded on a public blockchain. While Flipcash may have the ability to modify or suppress the display of certain User-Created Currency metadata within the Flipcash App — including where required to address intellectual property concerns or violations of our Terms of Service — Flipcash cannot guarantee the deletion or modification of information already recorded on a public blockchain. You are solely responsible for ensuring that any information you submit in connection with a User-Created Currency does not infringe third-party rights or violate applicable law.
Surveys: From time to time, we may offer you the opportunity to participate in one of our surveys. The information obtained through our surveys is used in an aggregated, de-identified form. We use this information to help us understand our users and to enhance the Flipcash Website and Flipcash App.
Marketing Communications: If you sign up to receive email marketing communications, such as newsletters, we collect your email address as well as other information on an optional basis to help us tailor our communications to you. You can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. Alternatively, you can opt out of receiving email marketing communications by contacting us at the contact information provided in the “Contact Us” section below. Please note that you may continue to receive transactional or account-related communications from us.
Contact Us: When you contact us with a comment, question or complaint through privacy@flipcash.com, you may be asked for information that identifies you, such as your name and telephone number, along with additional information such as your email address we need to help us promptly answer your question or respond to your comment. We may retain this information to assist you in the future and to improve our customer service and service offerings.
SHARING OF PERSONAL INFORMATION
We do not sell or disclose your personal information to third parties without your consent, except as set forth below or as required or permitted by law.
Service Providers: Your personal information will be transferred (or otherwise made available) to certain third parties that provide services on our behalf. We use service providers to provide services such as hosting the Flipcash App and Flipcash Website, providing user authentication and verification services, offering opportunities to buy Digital Assets, supporting the infrastructure for Currency Creator, Reserve Contract, and USDF-related functionality, and analyzing usage data and app performance. For example, we use Mixpanel, a third-party analytics service, to collect and analyze information about how users interact with the Flipcash App, including usage patterns, feature engagement, and app performance metrics. Mixpanel may collect device identifiers, session data, and in-app activity data on our behalf. In connection with Currency Creator and Reserve Contract functionality, categories of information that may be shared with infrastructure service providers include wallet addresses involved in transactions, transaction metadata (such as buy/sell amounts, timestamps, and pricing data), smart contract interaction data (including Reserve Contract parameters and User-Created Currency identifiers), and records of USDF-related transfers within the Flipcash App. Our service providers are only provided with the information they need to perform their designated functions and are not authorized to use or disclose personal information for their own marketing or other purposes.
Coinbase Guest Checkout: If you access Coinbase’s Onramp service through Apple Pay or Google Pay Guest Checkout within the Flipcash App, your personal information (including payment details and verification information) is collected and processed directly by Coinbase Inc. and not by Flipcash. Your use of Coinbase services is governed by Coinbase’s own privacy practices, which we do not control. We encourage you to review Coinbase’s Privacy Policy (available at https://www.coinbase.com/legal/privacy) before using Apple Pay or Google Pay Guest Checkout. FLIPCASH DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR ANY PERSONAL DATA YOU PROVIDE TO COINBASE OR FOR COINBASE’S HANDLING OF THAT DATA. In addition to its role as an Onramp provider, Coinbase serves as the issuer of USDF, the primary reserve asset within the Flipcash ecosystem. To the extent that any personal information is transmitted to or processed by Coinbase in connection with USDF issuance, redemption, or related transactions, such processing is governed by Coinbase's Privacy Policy and not by this Privacy Policy. Flipcash does not control Coinbase's data practices in its capacity as USDF issuer and disclaims all responsibility for Coinbase's collection, use, or handling of personal information in that capacity.
International Data Transfers: Your personal information may be transferred to, stored in, or processed in a jurisdiction outside of the country or region in which you reside, including the United States, Canada, or other countries where Flipcash or its third-party service providers have operations or data processing facilities.
As a result, your personal information may be subject to the laws of foreign jurisdictions, which may differ from those in your home country and may not provide the same level of data protection. In particular, personal information processed in the United States may be accessible to U.S. law enforcement and national security authorities under lawful access regimes.
In particular, Coinbase serves as both the provider of the Onramp service accessed via Apple Pay or Google Pay Guest Checkout and the issuer of USDF, the primary reserve asset within the Flipcash ecosystem. Data transmitted to Coinbase — whether in connection with Onramp transactions or USDF-related activity — will be processed in the United States. If you are located in the European Economic Area, the United Kingdom, Canada, or another jurisdiction with restrictions on international data transfers, you should be aware that any data transmitted to Coinbase will be subject to U.S. law, including applicable lawful access regimes. Coinbase's handling of such data is governed by Coinbase's own Privacy Policy (available at https://www.coinbase.com/legal/privacy), and Flipcash has no control over Coinbase's data practices.
Where required by applicable law, we implement appropriate safeguards to ensure that any international transfers of personal information are carried out in compliance with applicable privacy and data protection laws. These safeguards may include:
· Standard Contractual Clauses approved by regulators (where applicable),
· Data processing agreements with third-party service providers, and
· Other legally recognized mechanisms designed to protect your personal information.
By using the Flipcash App or Flipcash Website, or by providing us with your personal information, you consent to the transfer, storage and processing of your information in these jurisdictions.
Legal and Compliance: We and our service providers (including service providers located outside of the United States) may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable U.S. federal, state, or local law, or the law of any other jurisdiction in which we operate, or by legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.
Sale of Business: We may transfer any information we have about you as an asset in connection with a proposed or completed merger, acquisition or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of Flipcash or as part of a corporate reorganization or other change in corporate control.
INFORMATION ABOUT THE FLIPCASH APP
In addition, when you install or use the Flipcash App, we may collect and use the following additional information.
Usage Data and Device Information: As with many applications, certain limited data is required for the Flipcash App to function on your device. When you access and use the Flipcash App, we may automatically collect certain details of your access to and use of the Flipcash App, including the type of device hardware and operating system, unique device identifier, IP address, language settings, and the date and time the Flipcash App accesses our servers. We use this information to help us understand the activity on the Flipcash App, to monitor and improve the Flipcash App, and to tailor your Flipcash App experience. In addition, we may use third-party service providers to collect analytical information about your use of the Flipcash App, such as the Flipcash App features used and time spent on the Flipcash App, to help us tailor your in-app experience, improve our products and the quality of the Flipcash App, and to manage and analyze data in order to better understand our users.
Push Notifications: If you enable push notifications on your device, we may collect a unique identifier assigned to your device by your operating system or device manufacturer for the purpose of delivering notifications to you. We use this identifier to send you notifications related to your account and activity on the Flipcash App, such as transaction confirmations, Digital Asset price movements, and updates related to User-Created Currencies you hold or have created. You can disable push notifications at any time through your device settings. Please note that disabling push notifications will not affect our ability to contact you through other channels, such as email.
INFORMATION ABOUT THE FLIPCASH WEBSITE
Visiting the Flipcash Website: In general, you can visit the Flipcash Website without telling us who you are or submitting any personal information. However, we collect the IP (Internet protocol) addresses of all visitors to the Flipcash Website and other related information such as page requests, browser type, operating system and average time spent on the Flipcash Website. We use this information to help us understand the Flipcash Website activity and to monitor and improve the Flipcash Website.
Cookies: The Flipcash Website uses a technology called “cookies”. A cookie is a tiny element of data that the Flipcash Website sends to a user’s browser, which may then be stored on the user’s hard drive or other local storage so that we or third parties (such as our vendors or service providers) can recognize the user’s computer or device when they return. The data may contain a unique identifier or other information. Our vendors and service providers may use cookies or other technology to collect personally identifiable information about a user’s online activities over time and across different websites, including when using the Flipcash Website. We do not respond to browser-based “Do Not Track” signals. With respect to Global Privacy Control ("GPC") signals, because Flipcash does not sell your personal information or share it for cross-context behavioral advertising purposes, there is no sale or sharing activity from which to opt out; however, we will treat valid GPC signals in accordance with applicable law. You may set your browser to notify you when you receive a cookie or to not accept certain cookies. However, if you decide not to accept cookies from the Flipcash Website, you may not be able to take advantage of all of the Flipcash Website features.
THIRD PARTY LINKS
The Flipcash App and Flipcash Website may contain links to other websites that Flipcash does not own or operate. We provide links to third party websites as a convenience to the user. These links are not intended as an endorsement of or referral to the linked websites. The linked websites have separate and independent privacy policies, notices and terms of use. We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or disclose, secure and otherwise treat personal information. We encourage you to read the privacy policy of every website you visit. This includes third-party services such as Coinbase, which powers certain functionality in the Flipcash App (e.g., Apple Pay and Google Pay Guest Checkout). Use of these services is subject to their own privacy policies and terms.
BLOCKCHAIN DATA AND ON-CHAIN TRANSPARENCY
The Flipcash App facilitates transactions on public blockchain networks. You acknowledge and understand that blockchain transactions, including transfers of Digital Assets, interactions with Reserve Contracts, and the creation of User-Created Currencies, are recorded on a public, distributed ledger. Transaction data recorded on the blockchain, including wallet addresses, transaction amounts, timestamps, and smart contract interaction, is publicly visible, immutable, and cannot be deleted, modified, or erased by Flipcash or any other party. Third parties may be able to associate your publicly visible blockchain activity with your identity through independent analysis. Flipcash's obligations regarding the deletion, rectification, or erasure of personal information under this Privacy Policy or applicable law apply only to off-chain data within Flipcash's custody and control, and do not extend to data recorded on a public blockchain.
SAFEGUARDS AND RETENTION
We have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements. We have record retention processes designed to retain personal information for no longer than necessary for the purposes set out herein or as otherwise required to meet legal or business requirements. In general: (a) account and transaction-related information is retained for the duration of your use of the Flipcash App and for a reasonable period thereafter as necessary to fulfil the purposes described in this Privacy Policy or as required by applicable law and regulatory requirements; (b) information collected for customer support purposes is retained for a reasonable period following the resolution of the applicable inquiry; and (c) marketing-related information is retained until you withdraw your consent or unsubscribe, after which it will be deleted within a commercially reasonable timeframe. Notwithstanding the foregoing, transaction data recorded on public blockchain networks is permanent and immutable. Flipcash has no ability to delete, modify, or control the retention of on-chain data. Our retention and deletion practices apply solely to off-chain personal information within our custody and control.
YOUR CHOICES
Marketing Communications: As indicated above, if you have signed up to receive our email communications, you can unsubscribe any time by clicking the “unsubscribe” link included at the bottom of the email. Alternatively, you can opt out of receiving our marketing communications by contacting us using the contact information under “Contact Us” below.
Exercising Your Privacy Rights: Subject to applicable law, you have the right to access, update, rectify and correct inaccuracies in, and withdraw consent to the processing of, your personal information in our custody or control. You may make such a request or withdraw consent by emailing or writing to us using the contact information set out below. We may request certain personal information for the purpose of verifying your identity when you seek access to your personal information. Please note that the foregoing rights — including the right to deletion, rectification, and erasure — apply only to off-chain personal information within Flipcash's custody and control. These rights do not extend to data recorded on a public blockchain, which is immutable and cannot be modified, deleted, or erased by Flipcash or any other party. For more information, see the "Blockchain Data and On-Chain Transparency" section of this Privacy Policy.
AGE RESTRICTIONS AND CHILDREN’S PRIVACY
The Flipcash App and Flipcash Website are intended solely for users who have reached the age of legal majority in their jurisdiction. If you have not reached the age of legal majority in your jurisdiction, you are not permitted to use the Flipcash App, access the Flipcash Website, or provide any personal information to us. Without limiting the foregoing, the Flipcash App and Flipcash Website are not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13.
If we become aware that we have inadvertently collected personal information from a user who has not reached the age of legal majority in their jurisdiction, including a child under the age of 13, without verifiable parental or legal guardian consent (where applicable), we will take appropriate steps to delete that information from our records.
If you are a parent or legal guardian and believe that your child or ward who has not reached the age of legal majority has provided us with personal information, please contact us at privacy@flipcash.com so that we can take steps to delete the information.
PRIVACY GOVERNANCE POLICIES AND PRACTICES
We are committed to protecting your personal information and have implemented policies and practices that govern our treatment of personal information, including:
a privacy framework that defines the roles and responsibilities of our employees with respect to the treatment of personal information in our custody and control;
processes for responding to data subject requests and complaints concerning the handling of personal information in a timely and effective manner; and
a framework governing the retention and destruction of personal information that is designed to ensure compliance with our legal obligations.
UPDATES TO THE PRIVACY POLICY
We may update this privacy policy periodically to reflect changes to our privacy practices. We encourage you to periodically review this page to ensure you are familiar with those changes. We will indicate at the top of this privacy policy when it was most recently updated.
DISPUTE RESOLUTION
Any dispute arising out of or relating to this Privacy Policy or the collection, use, or processing of your personal information by Flipcash shall be subject to the dispute resolution provisions set forth in the Flipcash Terms of Service, including, for residents of the United States, the binding arbitration and class action waiver provisions contained therein. Please review the Terms of Service (available at https://www.flipcash.com/terms) for full details regarding the applicable dispute resolution procedures.
DATA BREACH NOTIFICATION
In the event of a security breach involving personal information in our custody or control that poses a real risk of significant harm to affected individuals, we will notify affected users and applicable regulatory authorities in accordance with, and within the timeframes required by, applicable data protection and privacy laws. Such notification will include, to the extent known at the time, a description of the nature of the breach, the categories of personal information affected, the measures taken or proposed to be taken to address the breach, and recommendations for steps you may take to mitigate potential harm. This commitment applies solely to off-chain personal information within Flipcash's custody and control and does not extend to data recorded on a public blockchain.
YOUR CALIFORNIA PRIVACY RIGHTS
If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"). The following disclosures are provided in accordance with the CCPA. In the preceding twelve (12) months, we have collected the following categories of personal information: (i) identifiers (e.g., IP address, device identifiers, email address provided for marketing or customer support); (ii) internet or other electronic network activity information (e.g., browsing history, usage data, in-app activity, interactions with the Flipcash App and Flipcash Website); (iii) geolocation data (e.g., locale and language preferences); and (iv) commercial information (e.g., Digital Assets transaction history, Reserve Contract interaction data, User-Created Currency creation and transaction metadata, and USDF-related transfer records). These categories are collected from the sources, for the purposes, disclosed to the third parties, and retained for the periods described elsewhere in this Privacy Policy. Flipcash does not collect or process sensitive personal information as defined under the CCPA (Cal. Civ. Code § 1798.140(ae)). As described in this Privacy Policy, we do not sell your personal information, nor do we share your personal information for cross-context behavioral advertising purposes, as those terms are defined under the CCPA. Subject to applicable exceptions, you have the right to: (a) know the categories and specific pieces of personal information we have collected about you; (b) request deletion of your personal information; (c) request correction of inaccurate personal information; and (d) opt out of the sale or sharing of your personal information. We will not discriminate against you for exercising any of your CCPA rights. We may request certain information from you in order to verify your identity before processing your request. If you designate an authorized agent to make a request on your behalf, we may require you to verify your identity directly with us and confirm that you have authorized the agent to act on your behalf.
ADDITIONAL INFORMATION FOR EEA AND UK RESIDENTS
If you are located in the European Economic Area ("EEA") or the United Kingdom ("UK"), the following additional information applies to you. We process your personal information on the following lawful bases, as applicable: (a) your consent, where you have provided it (for example, for marketing communications); (b) the performance of a contract with you, or to take steps at your request prior to entering into a contract (for example, to provide the Flipcash App and related services); (c) compliance with a legal obligation to which we are subject; and (d) our legitimate interests, provided that such interests are not overridden by your rights and freedoms (for example, to improve our services, detect fraud, and ensure the security of the Flipcash App). In addition to the rights described in the "Exercising Your Privacy Rights" section above, you may also have the right to: (i) request restriction of processing of your personal information; (ii) request portability of your personal information in a structured, commonly used, and machine-readable format; (iii) object to processing of your personal information based on our legitimate interests; and (iv) lodge a complaint with a supervisory authority in the EEA member state or UK country in which you reside or in which the alleged infringement occurred. Flipcash has not designated a Data Protection Officer at this time.
